For the purpose of these Terms and Conditions, the Maid Service Requestor shall be referred to as the Client(s) and Premier Maids Direct as PMD. The term ‘Client(s)’ shall be deemed to include the Client(s)’s spouse or partner, where applicable.
2. AMENDMENTS
PMD reserves the right to amend these Terms and Conditions and should this be necessary, shall inform the Client(s) of such changes by posting them to the PMD website, or to the Client(s), not less than 30 days before implementation of such changes.
3. INTRODUCTION
PMD shall introduce a Maid from its register of approved Maids to the Client(s) on and subject to these Terms and Conditions and to the Business Agreement (as attached hereto).
4. PAYMENT
The Client(s) shall sign the standing order mandate authorising payment as specified on the Business Agreement to be made by the bank of the Client(s) monthly in advance. Such payments shall continue until the Business Agreement is terminated in accordance with clause 8 of these Terms and Conditions.
PMD shall not forward the standing order mandate to the bank of the Client(s) until a Maid has commenced an arrangement with the Client(s).
5. CLIENT(S) OBLIGATIONS
The Maid is introduced to the Client(s) as a self employed Maid and the Client(s) shall retain the Maid only under a Contract for Services. The Client(s) shall agree with the Maid directly the terms of such contract.
The Client(s) shall agree with the Maid directly what services are to be performed by the Maid, and may change the scope and manner of the services by agreement with the Maid.
6. INSURANCE
All Maids introduced by PMD are self-employed and have their own Public Liability Insurance.
The limit of the cover of the Public Liability Insurance is £1,000,000. Neither your Maid nor his or her insurers shall accept liability for any claims of less than £250 in value and any such claims are hereby excluded, save for those in respect of personal injury. Where any claim is of a value in excess of £250 the Clients(s) shall be liable to pay the first £250 of any such claim. Details of the insurance cover are available on request.
No insurance claims for bleach damage will be accepted.
7. LIABILITY
Your Maid shall not be liable for any loss, damage or injury in excess of the limit of his or her insurance cover nor outside the scope of its cover as described in Clause 6.
PMD nor its Maids shall not be liable for any consequential or indirect losses incurred by Client(s) as a result of any failure of a Maid to comply with his or her contractual obligations for whatever reason.
8. TERMINATION
PMD may terminate the Business Agreement only by giving 30 days notice to the Client(s) in writing.
The Client(s) may terminate the Business Agreement only by giving 30 days notice to PMD in writing.
For a period of twelve months following termination of the Business Agreement the Client(s) shall not engage whether directly or indirectly as an employee, agent or otherwise any Maid who has been introduced by PMD to the Client(s). If the Client(s) so engage(s) a Maid, then a fee of £1000.00 may be claimed by PMD from the Client(s).
9. GENERAL
If any provision of these Terms and Conditions shall be found to be void, invalid or unenforceable, whether by a court of law, agreement of the parties or otherwise, the remainder of this agreement shall remain in full force and effect notwithstanding any such invalidity, illegality or unenforceability but the provision in question will either be amended so as to make it valid, legal and enforceable or in the event that this is not possible, deleted.
